Cutu Store Payment Plan Terms and Conditions

Effective date: 2 September 2026
Version: 1.0

These Payment Plan Terms and Conditions apply when a customer selects a payment plan for an eligible product on cutustore.com. They supplement the Cutu Store General Terms and Conditions, the Returns and Refunds Policy and the Privacy Policy.

If these Payment Plan Terms conflict with the General Terms on a matter specific to the Payment Plan, these Payment Plan Terms apply. Nothing in these Terms excludes or reduces any mandatory right available to a consumer under Maltese or European Union law.

Key information

  • The Payment Plan carries 0% interest and no payment-plan fee.
  • The total product price and every payment amount and date are shown before the order is submitted.
  • After the initial payment clears, Cutu Store may buy the product from a supplier in the United States, import it into Malta and reserve it for the customer.
  • The product remains in Cutu Store’s possession and is delivered after the full price has been paid in cleared funds.
  • The customer separately authorises the agreed future card charges at checkout.
  • One written extension of up to 30 calendar days may be approved. The Plan will not extend beyond 90 calendar days from acceptance.
  • Buying or importing the product does not remove the customer’s statutory consumer rights.

1. Seller information

Cutu Store is a trading brand of Bene Factum Services LLC.

Legal entity: Bene Factum Services LLC
Registered office: 5625 SW 142 Avenue, Miami, Florida 33183, United States
United States EIN: 88-0757196
Email: customercare@cutustore.com
Website: https://cutustore.com

Cutu Store operates online and sells products to consumers in Malta. Mandatory Maltese and European Union consumer rights apply where required by law.

2. Eligibility

The customer must:

  1. be at least 18 years old;
  2. act as a consumer and not for resale or business purposes;
  3. provide accurate billing, delivery and contact information;
  4. create or use a Cutu Store customer account;
  5. use a payment method that the customer is authorised to use; and
  6. have an eligible delivery address in Malta unless Cutu Store expressly agrees otherwise.

Cutu Store may decline a Payment Plan before acceptance because of product availability, payment verification, suspected fraud, legal restrictions or an inability to complete the order. Any amount already collected for a declined Plan will be refunded without undue delay.

3. Nature of the Payment Plan

The Payment Plan is a layaway arrangement for a sale of goods. It allows the customer to pay the product price in the instalments shown at checkout. Cutu Store does not charge interest or a payment-plan fee.

Cutu Store remains the seller. Cutu Store buys and imports the product for its own account and retains possession until the full price is paid. The customer is not appointed as the importer of record and does not acquire title or possession through the initial payment.

The commercial name given to the Plan does not override its classification under applicable law. Any mandatory consumer-credit rule that applies will prevail over an inconsistent term.

4. Information provided before the order

Before the customer submits the order, Cutu Store will display or provide:

  1. the product, model, SKU and selected variation;
  2. the total price, including applicable taxes and charges;
  3. the initial payment;
  4. the amount and due date of every later instalment;
  5. the 0% interest rate and absence of a payment-plan fee;
  6. the automatic card-charge arrangement;
  7. the rule that delivery takes place after full payment;
  8. the ordinary end date and maximum extension;
  9. the missed-payment and cancellation process; and
  10. links to these Terms, the General Terms, the Returns and Refunds Policy and the Privacy Policy.

The order confirmation and payment-plan email form the order-specific Payment Schedule. The customer should retain these emails.

5. Contract formation

Submitting the order is an offer to enter the Payment Plan. The contract is formed when:

  1. the initial payment has cleared; and
  2. Cutu Store sends written confirmation that the Payment Plan is active.

The accepted contract consists of these Terms, the order-specific Payment Schedule, the product description, the checkout summary and the policies incorporated by reference.

6. Price and payments

The total price shown at checkout is the total amount payable for the product under the Plan. Cutu Store will not add interest, an extension fee or a late-payment fee.

The initial payment is credited towards the total price. Each later instalment reduces the remaining balance. Cutu Store will provide an electronic record of each successful payment.

Cutu Store will not change an accepted payment amount or date without the customer’s express agreement, unless a correction is required by law or an approved extension changes the relevant date.

7. Initial payment, acquisition and reservation

After the initial payment clears, Cutu Store may place the supplier order, pay the supplier, arrange transport from the United States, complete import procedures and hold the product in Malta.

The customer understands that these steps may begin shortly after Plan acceptance. This acknowledgement does not waive or restrict the customer’s statutory withdrawal, refund, conformity or other consumer rights.

Cutu Store bears its own procurement, freight, customs, tax and import costs as seller, except for a charge expressly included in the total price before checkout. No new import charge will be added after acceptance.

Cutu Store will identify and reserve the acquired product for the order. It will store the product with reasonable care and will not deliver it until the balance has been paid in full.

8. Authority for future card charges

At checkout, the customer must give a separate affirmative authorisation for future card charges. By giving that authorisation, the customer permits Cutu Store’s payment provider to charge the saved payment method for the exact instalments and on the dates shown in the Payment Schedule.

The payment provider stores a token or payment-method reference. Cutu Store does not store the complete card number or security code.

If a scheduled charge fails, Cutu Store will notify the customer before another charge attempt. The customer may pay through another accepted method.

The customer may revoke the authority for future automatic charges by emailing customercare@cutustore.com before the next charge is submitted for processing. Revocation stops future automatic charge attempts after it is processed. It does not cancel the sales contract or remove the obligation to pay an instalment by another accepted method.

Nothing in these Terms restricts any statutory or card-scheme right to dispute an unauthorised or incorrect transaction.

9. Payment dates and reminders

The customer must ensure that each instalment is paid by its due date. Cutu Store may send a reminder before a scheduled payment. Failure to receive a reminder does not change the agreed date.

A payment is treated as paid when Cutu Store receives it in cleared funds. A failed or declined card charge is not a completed payment.

10. One-time extension

The customer may request one extension of up to 30 calendar days. The request must be sent to customercare@cutustore.com before the affected payment expires or during the cure period in section 11.

The request must identify the order, the affected instalment and the proposed payment date. An extension takes effect only when Cutu Store approves it in writing.

An extension does not add interest or a fee. The final payment date must remain within 90 calendar days after Plan acceptance. Cutu Store may refuse an extension for an objective legal or operational reason and will explain that decision briefly.

11. Missed payments and cure period

If an instalment is missed, Cutu Store will send a written notice that states:

  1. the unpaid amount and original due date;
  2. how the customer can pay;
  3. the deadline to correct the missed payment;
  4. how to request the one-time extension; and
  5. what will happen if the payment remains unpaid.

The customer will receive at least 14 calendar days from the notice to correct the missed payment. Cutu Store will pause termination while it reviews a timely extension request or a genuine payment dispute.

12. Termination after an uncured missed payment

If the customer does not correct the missed payment within the cure period and no extension applies, Cutu Store may terminate the Plan by written notice. Future automatic charges will stop and the product may be returned to stock, returned to the supplier or resold.

Payments are not automatically forfeited. A valid statutory withdrawal is handled under sections 13 and 14.

If no statutory withdrawal or mandatory refund right applies, Cutu Store may claim an actual direct net loss caused by an uncured contractual breach where Maltese law permits. Cutu Store must take reasonable steps to reduce that loss, credit any supplier refund, insurance recovery, tax recovery and net resale proceeds, avoid double recovery and provide an itemised calculation. Cutu Store will not impose a fixed penalty or retain an amount that exceeds the lawful net loss.

Cutu Store will return any undisputed balance due to the customer within 14 calendar days after completing the final account. Cutu Store will not deduct a disputed amount from a statutory refund unless applicable law expressly permits that deduction.

13. Statutory right of withdrawal

For a distance contract involving goods, a consumer normally has 14 days after receiving the goods to withdraw without giving a reason. The consumer may also communicate the decision to withdraw at any time before taking physical possession of the goods.

To withdraw, the customer must send a clear statement to customercare@cutustore.com or use the model form at the end of this page. The notice should identify the customer, order and product.

The fact that Cutu Store has already ordered, transported, imported or reserved the product does not remove the statutory right of withdrawal for a standard, non-personalised product.

Statutory exceptions apply only when their legal conditions are met. A sale or promotional price does not remove withdrawal or conformity rights.

14. Refunds following statutory withdrawal

If the customer withdraws before delivery, Cutu Store will refund all payments received under the Plan without undue delay and no later than 14 days after receiving the withdrawal notice. Cutu Store will not deduct its supplier, freight, customs, import tax or handling costs from that statutory refund.

If the customer withdraws after delivery, the customer must return the product within 14 days after giving notice, unless Cutu Store agrees to collect it. The customer pays the direct return cost where the law permits and Cutu Store provided that information before the contract.

Cutu Store may withhold the post-delivery refund until it receives the returned goods or evidence that they were sent back, whichever occurs first. Cutu Store may deduct a lawful amount for diminished value caused by handling beyond what was needed to establish the product’s nature, characteristics and functioning.

Refunds will be made through the original payment method unless the customer expressly agrees to another method and incurs no fee as a result.

15. Ownership, risk and delivery

The product remains Cutu Store’s property until the full price has been received in cleared funds. Risk remains with Cutu Store until the customer, or a person nominated by the customer other than the carrier, takes physical possession.

After the final payment clears, Cutu Store will release the product and arrange delivery to the address in the order. The applicable delivery method and estimate will be stated in the order confirmation. Unless another date was expressly agreed, delivery will take place without undue delay and no later than 30 days after full payment.

The customer must keep the delivery address and contact details accurate. Cutu Store may charge an actual and reasonable second-delivery cost if delivery fails because the customer supplied incorrect information or was unavailable after reasonable notice.

16. Product availability and cancellation by Cutu Store

If Cutu Store cannot obtain the agreed product, cannot lawfully import it or cannot perform the Plan, it may offer an equivalent product or revised timing. The customer does not have to accept an alternative.

If no alternative is accepted, Cutu Store will cancel the Plan and refund every payment received without undue delay and no later than 14 calendar days after cancellation.

17. Faulty or non-conforming goods

The Payment Plan does not reduce the legal guarantee or any remedy for goods that are faulty, unsafe, damaged, counterfeit, not as described or otherwise non-conforming.

Mandatory remedies may include repair, replacement, price reduction or termination and refund, according to applicable law. A manufacturer’s warranty is separate from the customer’s statutory rights.

These rights apply to full-price and discounted products.

18. Customer account and records

A customer account is required so the customer can review the order and payment status. Cutu Store will record the version of these Terms accepted at checkout, the Payment Schedule, consent text, date and time, order and customer identifiers, transaction records and relevant technical evidence.

The version accepted when the Plan is formed will continue to govern that Plan. A later website update will not change an accepted Plan without the customer’s agreement or a legal requirement.

19. Personal data

Cutu Store processes personal data to create and administer the Plan, collect payments, prevent fraud, acquire and import the product, communicate with the customer, deliver the order, manage returns and comply with legal duties.

Payment data may be processed by Stripe and the payment technology providers identified in the Cutu Store Privacy Policy. Cutu Store uses tokenised payment references and does not store complete card details.

Further information about legal bases, recipients, retention, international transfers and data-subject rights appears in the Privacy Policy at https://cutustore.com/privacy-policy/.

Marketing consent is optional and separate from Payment Plan acceptance.

20. Communications

Plan confirmations, payment records, reminders, failed-payment notices, extension decisions, termination notices and delivery updates will be sent to the email address connected to the order. The customer must keep that address current.

Email notices and downloadable account records are durable records that the customer can retain. Either party may show that a notice was not received or contained an error.

21. Complaints and dispute resolution

The customer should send a complaint to customercare@cutustore.com and include the order number, a description of the issue and the requested resolution. Cutu Store aims to acknowledge complaints within five working days and provide a substantive response within 15 working days.

If the complaint is not resolved, a consumer may contact the Office for Consumer Affairs within the Malta Competition and Consumer Affairs Authority or use an available consumer alternative dispute resolution service. Information is available at https://mccaa.org.mt and https://adr.mccaa.org.mt.

These Terms do not restrict access to a competent court or tribunal.

22. Governing law

These Terms are governed by Maltese law. This choice does not deprive a consumer of mandatory protection granted by the law of the country where the consumer habitually resides when that law applies.

The courts and tribunals of Malta have jurisdiction, subject to any mandatory consumer right to bring or defend proceedings in another competent jurisdiction.

23. Changes, assignment and severability

Cutu Store may update these Terms for future Plans. The effective date and version will appear at the top of the page.

Cutu Store will not transfer an accepted Plan in a way that reduces the customer’s legal protection without consent. The customer may not transfer the Plan to another person without written agreement.

If a term is invalid or unenforceable, it will be limited or removed to the extent required by law. The remaining terms will continue where they can operate lawfully.
